Myndura Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of Myndura, an interactive psychiatric education platform operated by Mynda Tech Solutions ("we", "us", "our"). By creating an account or using the Myndura platform (web or mobile), you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Myndura.

These Terms apply to all users, including students, trainees, qualified clinicians, and educators.


2. Educational Purpose — NOT Clinical Advice

This section is the most important part of these Terms. Please read it carefully.

2.1 Myndura is an educational tool

Myndura is designed exclusively as an educational resource to help mental health professionals and trainees learn psychiatric concepts, explore clinical reasoning frameworks, and test their knowledge. It is a learning platform — nothing more.

2.2 Myndura is NOT a clinical decision support system

Myndura is not a clinical decision support system, a diagnostic tool, a prescribing reference, or any form of professional medical, psychiatric, or clinical advisory service. It must not be used as one.

2.3 Content is for educational purposes only

All content on Myndura — including labs, practice questions, knowledge maps, AI tutor responses, case scenarios, drug information, diagnostic frameworks, and any other material — is provided for educational purposes only. It must not be used to make, inform, guide, or justify patient care decisions of any kind.

2.4 Do not use this platform for patient care decisions

You must not rely on any content from Myndura — including AI tutor responses — when diagnosing, treating, prescribing for, or otherwise making decisions about real patients. Patient care decisions must be based on:

  • Authoritative clinical guidelines (e.g. NICE guidelines, DSM-5, ICD-11, the BNF, Australian clinical guidelines);
  • Your institution's protocols and policies;
  • Up-to-date primary clinical literature; and
  • Your own clinical judgment, training, and supervision.

2.5 Always defer to authoritative sources

Clinical knowledge evolves continuously. Even content that is accurate at time of publication may become outdated. You are responsible for verifying any clinical information against current authoritative sources before applying it to patient care.


3. AI Tutor Limitations

3.1 The AI tutor is powered by a third-party model

Myndura's AI tutor feature is powered by Anthropic's Claude API, a large language model. Like all AI language models, it can produce errors, hallucinations, outdated information, or responses that appear plausible but are clinically incorrect.

3.2 AI responses are educational discussion, not clinical guidance

All AI tutor responses are framed as educational discussion. They do not constitute clinical advice, professional opinions, or guidance on the management of any real patient.

3.3 What the AI tutor will not do

The AI tutor is designed with the following hard limits. It will not:

  • Simulate or roleplay as a real patient;
  • Provide direct clinical advice about the management of real patients;
  • Generate specific treatment recommendations, prescribing decisions, or care plans for any individual;
  • Act as a substitute for clinical supervision or professional consultation.

If the AI tutor appears to provide information that could be interpreted as clinical advice, you must not act on it. This would represent a misuse of the platform.

3.4 Verify all information against authoritative sources

All information provided by the AI tutor — including drug names, dosages, diagnostic criteria, treatment protocols, and clinical guidelines — must be independently verified against authoritative clinical sources before it is used in any clinical context. These include, but are not limited to, the British National Formulary (BNF), NICE guidelines, DSM-5, ICD-11, and your institution's own formulary.

3.5 Drug information may contain errors

Drug names, dosages, interactions, contraindications, and other pharmacological information displayed anywhere on Myndura — including AI tutor responses — may contain errors. You must always cross-reference drug information with an up-to-date, authoritative formulary before any clinical application.


4. Account Terms

4.1 One account per person

Each account is for the exclusive use of one individual. You must not share your account with or transfer it to any other person.

4.2 Provide accurate information

When creating your account, you must provide accurate and truthful information about yourself, including your professional role, training level, and any information required for subscription tier verification (e.g. student status). Providing false information may result in account termination.

4.3 Keep your credentials secure

You are responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party. If you suspect unauthorised access to your account, you must notify us promptly at legal@myndura.com.

4.4 You are responsible for activity under your account

You are responsible for all activity that occurs under your account, whether or not you authorised it. We are not liable for any loss or damage arising from your failure to maintain the security of your account.


5. Subscription and Billing

5.1 Subscription tiers

Free tier provides limited access: up to 3 labs and 2 daily practice questions per day.

Student tier requires verification of current enrolment in an eligible programme. Misrepresenting your student status is a breach of these Terms.

5.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Prices are in US dollars (USD) unless otherwise stated. Applicable taxes may be added at checkout depending on your jurisdiction.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. On cancellation, your access to paid features continues until the end of the current billing period. No partial-period refunds are issued except as provided under clause 5.4.

5.4 Refunds

Because every new user is offered a free 7-day Pro trial (no credit card required) before any payment is taken, we do not operate a general "change of mind" refund policy. You are expected to use the trial period to decide whether Myndura is right for you.

After a paid subscription has started, we will consider a refund request within 7 days of the purchase only where there is a clear, demonstrable reason, including (but not limited to):

  • A duplicate or accidental charge;
  • A billing error on our side (wrong amount, wrong tier, wrong currency);
  • A failed cancellation that resulted in an unwanted renewal being processed within 7 days;
  • A technical fault that prevented you from accessing the service you paid for, and which we were unable to resolve;
  • A legal right to a refund under the consumer protection laws of your jurisdiction.

Refunds will not normally be issued for:

  • "Change of mind" or subjective dissatisfaction after the free trial has ended;
  • Non-use of the service after the subscription has started;
  • Renewal charges beyond 7 days after the renewal date (please cancel before renewal to avoid being charged);
  • Requests made more than 7 days after the original charge.

Refund requests should be sent to legal@myndura.com with your account email, the date of the charge, and a description of the reason. We will respond within 10 business days. Where a refund is approved, it will be issued to the original payment method.

This clause does not exclude or limit any statutory rights you may have as a consumer in your jurisdiction that cannot be excluded by contract.

5.5 Price changes

We may change subscription prices from time to time. We will give at least 30 days' notice before any price increase takes effect for existing subscribers.


6. Acceptable Use

By using Myndura, you agree that you will not:

6.1 Enter real patient data

You must not enter any real patient information into Myndura under any circumstances. This includes names, dates of birth, identification numbers, contact details, clinical histories, diagnoses, medications, or any other information that identifies or could be used to identify a real individual. Myndura is not designed to receive, store, or process personal health information and is not compliant with clinical data protection obligations.

6.2 Share account credentials

You must not share your login credentials with any other person or allow any other person to access Myndura using your account.

6.3 Scrape, copy, or redistribute content

You must not use automated tools to scrape, extract, or harvest content from Myndura. You must not copy, reproduce, republish, transmit, or distribute any platform content — including labs, questions, knowledge maps, or AI tutor responses — without our prior written consent.

6.4 Generate clinical documentation

You must not use Myndura, including the AI tutor, to generate clinical documentation for use in patient records, referral letters, discharge summaries, prescriptions, or any other clinical output.

6.5 Misrepresent AI tutor responses

You must not present, share, or use AI tutor responses as professional clinical advice, expert opinion, or authoritative medical guidance — to colleagues, patients, supervisors, or any other party.

6.6 Engage in prohibited conduct generally

You must not use Myndura for any unlawful purpose, or in any way that violates these Terms, applicable laws, or regulations.


7. Content Ownership

7.1 Our content

All content created or curated by Myndura — including but not limited to labs, practice questions, knowledge map data, AI tutor system prompts, educational text, case scenarios, and visual design — is owned by Mynda Tech Solutions and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use this content for your personal educational purposes only.

7.2 Your content

You retain ownership of any personal notes and flagged response reports you create within the platform. By submitting a flag or report, you grant us a non-exclusive licence to review and act on it for the purposes of improving platform content accuracy.


8. Content Accuracy

8.1 We strive for accuracy

We take clinical accuracy seriously. Platform content is authored and reviewed by qualified mental health professionals. However, despite our best efforts, errors, omissions, and outdated information may exist.

8.2 Content is not a substitute for primary sources

Platform content is not a substitute for primary clinical literature, authoritative guidelines, or professional supervision. It reflects educational summaries, not definitive clinical standards.

8.3 Reporting errors

If you encounter content that you believe is clinically inaccurate, outdated, or potentially harmful, please use the "Flag" feature within the platform or contact us at legal@myndura.com. We treat accuracy reports seriously and review them promptly.


9. Termination

9.1 Termination by you

You may close your account at any time by contacting us or using the account settings in the platform.

9.2 Termination by us

We reserve the right to suspend or permanently terminate your account, without refund, if we determine that you have:

  • Entered real patient data into the platform;
  • Misrepresented AI tutor responses as clinical advice;
  • Breached any material provision of these Terms;
  • Provided false information to obtain a subscription tier you are not entitled to; or
  • Engaged in any conduct that poses a risk to patient safety, platform integrity, or other users.

We will generally notify you before terminating your account unless doing so would cause harm or is impractical.


10. Limitation of Liability

10.1 No liability for clinical decisions

To the maximum extent permitted by law, Mynda Tech Solutions accepts no liability — whether in contract, tort, statute, or otherwise — for any harm, loss, or adverse outcome arising from:

  • Any clinical decision made in reliance on Myndura content or AI tutor responses;
  • Any patient harm resulting from the use or misuse of information obtained from Myndura;
  • Any errors, inaccuracies, or omissions in platform content.

You use Myndura at your own risk for educational purposes. You remain solely responsible for your own clinical practice and patient care decisions.

10.2 General limitation

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or in connection with these Terms or your use of Myndura — regardless of the cause of action — will not exceed the total subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.

10.3 Exclusion of consequential loss

To the maximum extent permitted by law, we exclude all liability for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of income, or loss of professional opportunity.


11. Disclaimer of Warranties

Myndura is provided "as is" and "as available". We make no warranty, express or implied, that:

  • The platform will be uninterrupted, error-free, or secure;
  • Content will be accurate, complete, current, or fit for any particular educational purpose;
  • The platform will meet your specific training needs.

Nothing in these Terms excludes any statutory rights you may have that cannot lawfully be excluded.


12. Changes to Terms

We may update these Terms from time to time. For material changes, we will:

  • Notify registered users by email to the address associated with their account;
  • Provide at least 30 days' notice before the updated Terms take effect.

Continued use of Myndura after the effective date of updated Terms constitutes acceptance of the new Terms. If you do not agree to updated Terms, you must stop using the platform and may close your account.

Minor or non-material changes (such as typographical corrections or clarifications that do not alter your rights) may be made without notice.


13. Governing Law and Disputes

These Terms are governed by the laws of Australia (jurisdiction to be confirmed by legal counsel prior to publication). Any disputes arising from or related to these Terms or your use of Myndura will be subject to the exclusive jurisdiction of the courts of Australia.

Note to legal counsel: Please confirm the appropriate jurisdiction (state/territory) and dispute resolution mechanism (e.g. arbitration clause, specific court) before this document is published.


14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining Terms will continue in full force and effect.


15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mynda Tech Solutions regarding your use of Myndura and supersede all prior agreements, representations, or understandings.
